So, we looked at the case of Jack Stanton vs. Bruce Jackson, Director of Boys State Elections in this blog item...

So, we looked at the case of Jack Stanton vs. Bruce Jackson, Director of Boys State Elections in this blog item.

(UPDATED - 7:20 pm)

Mr. Stanton plods on.

In his earlier ruling, Judge Snyder did not address the issue of Mr. Stanton's request for a slot in the program for the Wednesday evening Candidates' Forum. He intends to mount a write-in campaign, but would also like an opportunity to address the voters at the Forum.

Judge Snyder ruled that the Director of Elections had no jurisdiction over the Candidates Forum program, and denied that request for relief.

Mr. Stanton then spent the afternoon acquiring 140+ signatures from Boys State citizens supporting his request for an opportunity to speak. When last seen, Jack Stanton was furiously combing the Stonehill College campus looking for Timothy Smith, Candidates Forum Coordinator in order to serve him with papers and get time (again) in front of a Boys State judge.

Mr. Stanton just stopped by my dormitory to ask if I know where he can find a judge. Turns out he was able to find Timothy Smith and serve him, and now seeks out a judge to schedule another emergency hearing. Meanwhile, time runs on. If Jack Stanton can't find himself a Boys State judge and get a ruling before 8:00 pm - given that he has other responsibilities at Boys State - he may just be out of luck.

So, it seems Mr. Stanton did indeed get his day in court. Again. He found a judge and argued his case. I'm told that the court rejected his motion for a speaking slot in tonight's Candidate's Forum. I spoke with him briefly outside of the dining hall and he seemed to understand the judge's ruling and will move forward with his write-in campaign.

John Brady has been on staff at Boys State for 20 years. He coordinates the Samsung Scholarship, the College Fair, and a host of other events throughout the week. He's also the lead counselor of T-6, and has been for 15 or so years.

In his non-Boys State time, John works for the College Board, and resides in New Jersey. We interrupted his breakfast to ask a few questions.

Stanton v. Jackson, Docket No. 09-CV-01

Read about Stanton v. Jackson in the *June 17, 2009 edition of The Citizen* (http://www.maboysstate.org/docs/Citizen061709.pdf).

So, Jack Stanton...

Read about Stanton v. Jackson in the June 17, 2009 edition of The Citizen.

So, Jack Stanton underwent the process to mount an independent candidacy for United States Senator. He consulted with Bruce Jackson, Director of Elections at Massachusetts Boys State and was provided the proper form for obtaining the necessary 50 signatures to have his name inserted onto the ballot as an independent candidate. He submitted the document to Mr. Jackson within the prescribed time.

. . . and then a problem.

One of Mr. Stanton's signatures carried an improper Boys State I.D. number. Instead of writing his correct number "150," the signer wrote "105." The Director of Elections disqualified the signature and Mr. Stanton was unfortunately left one signature shy of the required 50. He sued. He also filed an emergency motion to compel the Director of Elections to insert his name on the ballot.

A hearing on the motion was scheduled before Judge Robert Snyder at 8:30 in the Boys State Court. Arguments were made by Mr. Stanton's team of attorneys licensed to practice before the Boys State Court. Dean of the Judiciary T.J. Recupero argued the case on behalf of Director Jackson.

This is the post mortem interview with Mr. Stanton and his legal team.

The result is below the video clip.

The judge ruled in favor of the defendant, Bruce Jackson. The issue largely turned on a waiver signed by Mr. Stanton, wherein he acknowledged that the decision of the Director of Elections on the validity of signatures was final and no appeal could be taken. The judge did acknowledge, though, that the candidate should be entitled to a write-in candidacy and ordered that the Director of Elections leave sufficient room on the ballot for a write-in vote. He further ordered that the Director amend his independent candidacy form in future years to include more than 50 signature lines so that candidates know that they should be responsible for acquiring more than the required number of signatures in the event that any are invalidated.

But don't take my word for it. Here's Judge Snyder making his ruling. We unfortunately didn't get all of it on video.

This was an interesting find. Yesterday, about 20 minutes before party conventions, I walked into the Federalist Party Convention Hall and came across Max. Max is a candidate for Lt. Governor, seeking the nomination from the Federalist Party. He was alone in the hall, practicing his speech to empty seats, and very much rapt with the notion that, if he did well, he could actually win the thing.

So, I took three clips. The first is where I interrupted him alone in the hall. The second is where I asked him to practice his speech before the camera, and then we sat down and talked about it. The third is Max giving his speech to a live Convention, and the reaction he received.

I received this note through the blog messenging feature. This gentleman went to Boys State in 1985.

It was a good read. Thank you for sending it.
I just wanted to say hello to you and all the folks at the program. This year, more than ever, I put many of the lessons learned at Boys' State to use in the real world, as I recently ran for (and won) re-election to the School Committee in my home town. Standing before my Boys' State town and party in 1985 campaigning for statewide office was eerily similar to standing before the my town's Chamber of Commerce or the Council on Aging stumping for votes. It was really all about getting out there with friends and family on Saturdays at the post office, the ball fields, the town events, shaking hands and getting my message out. With my 4 kids and their friends in tow, we took over the center of town on many a night with our signs to talk with folks about issues facing our schools and ideas on how to fix our problems. I have to tell you that the whole experience caused me to sit back and examine the path my life has taken in the 20+ years since my principal called me to his office, for once not to inquire as to my role in some unexplained prank at the school, but to tell (not ask) me that I was going to Boys' State because "it would change my life."

To have had the opportunity to attend Boys' State, and to have met so many caring people there who have impacted my life in such a meaningful way, I consider myself blessed. Though work and family obligations have kept me from attending the program the past few years, I wanted to make some small contribution, albeit words, that may be of benefit to this years' attendees: make the most of your experience during this week; do not be afraid to try something new or to lose; those that may be laughing are laughing with you; every once in a while, laugh at yourself; consider wearing a blue shirt at some point in the future; and lastly, take your time growing up -- before you know it, you just might find yourself writing an email like this one and realizing how great life is because of the people who cared about you and started you on your journey.

I hope that you all have another awesome week, and I look forward to seeing you soon. Please say hi to all of the staff for me.

Yours cordially,

-Brian
At Boys State, though, the risk of asking Andy and Liam to hold the video camera for a few hours is that they'll film soccer. And so they did.
